Host Agreement

Version 1 — August 18, 2026. Accepted at sign-up; applies alongside the platform Terms of Service and the Refund Policy.

1. Who can host, and where this agreement applies

This agreement is written for accommodation located in Montenegro and is governed by Montenegrin law (Section 11). If you list property in another country, the local obligations in Section 6 do not describe your duties — you remain responsible for the registration, licensing and tax rules of the jurisdiction the property sits in, and we will agree separate terms with you before your listing accepts paid bookings. Ask us before listing outside Montenegro.

You must be at least 18, have the legal right to rent out the space you list (we may ask for proof), and list only property you own or are authorised to manage. A free listing takes guest inquiries only. Before your listing can accept paid bookings you must complete identity verification: a government-issued photo ID matched to your account details and to the name on your payout account. Accounts that cannot be verified cannot accept bookings.

2. Hosting standards

Four ground rules apply to every listing, on every plan:

These standards are measured continuously through guest reviews, response times and resolution outcomes.

3. Guest cancellations

You choose a guest cancellation policy per listing (Flexible, Moderate, Strict or Super Strict, defined in the platform Terms of Service). In addition, every booking made at least 7 days before check-in carries a 24-hour free-cancellation window for the guest, regardless of your policy.

4. Host cancellations

Cancelling a confirmed booking harms the guest and the platform's trust. Where you cancel a confirmed booking, we may charge a cancellation fee, which we may net from your future payouts. Our published scale is:

We will tell you in writing before charging a cancellation fee, and you can respond first. The cancelled dates are blocked from re-booking, the cancellation counts against your tier standing, and repeated cancellations are grounds for suspension. Fees are not charged for documented force majeure or for valid, evidenced concerns about guest behaviour.

5. Payments and fees

Guest payments are processed by our payment partner (Stripe). The platform commission — published at hosts.montenegro.com and locked at the moment each booking is made — is all-inclusive: we pay the card-processing fees. You are never charged a payment surcharge on a montenegro.com booking, and no commission applies to inquiries. Bookings taken on your own property website carry no commission either — for those we pass through our payment-processing cost plus €1 per booking, because we are not the one selling the stay. Payouts are released in weekly batches following guest check-in. There are no subscriptions or software charges of any kind — every host tool is free, and commission on montenegro.com bookings is the only amount we ever deduct; see the Refund Policy.

Payment agency.You appoint Montenegro.com (Axora Group LLC) as your limited agent solely to collect guest payments on your behalf. A guest's payment to us fully discharges that guest's payment obligation to you for the booking, and from that moment the obligation to remit the funds to you (less our commission) is ours under this agreement. This appointment exists so guests can pay securely on the platform; it does not make us a party to the accommodation contract between you and the guest.

6. Taxes and local obligations

You are responsible for your own taxes and local obligations as a Montenegrin accommodation provider: income tax, VAT where applicable, tourist (sojourn) tax, guest registration with the authorities, and any municipal fees or licences. Montenegro.com provides tooling that helps (guest data collection, tourist-tax ledger, reports) but the legal responsibility for registering guests, filing and paying remains yours. Commission statements we issue to you are exclusive of any taxes you owe on your own income.

7. Guest resolutions — how problems get fixed

Guests can raise a resolution case about their stay — today by writing to [email protected] or replying in the booking thread; a self-serve form is being built. The process is designed so that you fix the problem, not us:

Strikes escalate: a first strike is a warning; active strikes freeze plan upgrades; repeated or serious strikes are grounds for suspending bookings, delisting the property, or refusing service altogether. Montenegro.com reserves the right to suspend, delist or refuse service to any host whose conduct falls below these standards, consistent with our published policies and applicable law. Strikes age out after 12 months of clean hosting.

8. Plan tiers and standing

Moving to a higher plan tier requires good standing: no unresolved resolution tickets and no active strikes at the time of upgrade. Performance-based tier upgrades additionally require verified identity, a configured payout account, and the published rating and reliability thresholds.

9. Term and termination

You can stop hosting at any time — cancel from your console; confirmed bookings must still be honoured or are treated under Section 4. Your content and data remain exportable. We may terminate or suspend this agreement for material breach, fraud, illegal content, or the resolution-based grounds in Section 7.

10. Guest data — data processing terms

When a guest completes your registration link, they give identity document details so that you can meet your legal duty to register guests and account for the tourist tax. For that data you are the data controller and we act as your processor. On those terms we: process it only on your documented instructions and to run the service; keep it confidential and apply appropriate technical and organisational security; engage sub-processors only for hosting, storage and delivery of this platform, under equivalent obligations; assist you with data-subject requests, breach notification and any impact assessment; and delete or return the data when your account closes, subject to the retention periods in our Privacy Policy. We do not use guest registration data for our own marketing. You instruct us to process it for guest registration, tourist-tax calculation, reporting and export, and you confirm you have a lawful basis for collecting it. For all other personal data on the platform — your account, bookings, messages, marketing — we are the controller in our own right.

11. General

This agreement is governed by the law of Montenegro. We may update these terms; material changes are announced to hosts at least 30 days before they take effect, and continuing to host after that constitutes acceptance. If any provision is found invalid, the rest remains in force.
